District of Columbia Circuit Court and Fourth District Circuit Court Opinions on Obamacare

Two opposing rulings have been made by Circuit Courts today regarding the “Obamacare” subsidies as follows:

Opposed -District of Columbia Circuit Court – this decision will be appealed by the Obama Administration

D.C. Circuit Court of Appeals ruling in Halbig v. Burwell

In Favor of – 4th Circuit Court of Appeals

4th Circuit Court of Appeals ruling in King v. Burwell

  1. I just finished reading the online version Richard. Aside from the fact that HSA’s aren’t a one-size fits all solution, the major problem I see with them is they basically defeat the entire premise behind the ACA, which is to stay ahead of the game by addressing various health needs before they become problems. If you’re paying for your health care yourself, out of pocket, you’re going to limit your costs by NOT getting this test, or that test or something else. There were a couple of interesting comments posted to the online version of the editorial.

    But, you’re absolutely correct. More and more of the provisions being brought forward are intended to provide for the rich while doing little or nothing for the poor, and that’s going to continue to be the case as long as we allow Republicans to control the purse strings. Too many Republicans are financially well off and have no concept of what it is like to be in the middle class, trying to survive from one paycheck to the next.

  2. The Columbus Dispatch this morning had an editorial endorsing the health savings account as the answer to the replacement of Obamacare. Does everybody know and understand that the
    health savings account already exists? It’s another benefit for the rich and well-to-do who get
    to charge off health care expenses to the government via the income tax route. If you’re too
    poor to pay taxes, what good is a health savings account?
